Are the Brain Training games copyrighted?

If it's been offered for sale it's more likely than not copyrighted. You'd have to contact the copyright holder to get permission to use their work. If you don't want to do that or they won't let you you'll have to come up with your own things. If you plan to ever sell your work it should be all yours.
